This blog is back after a short break with the publication of the latest REMIT Quarterly newsletter by ACER, which can be found here. In addition to the usual statistics, the newsletter covers reporting volumes over the last year and also a breach of REMIT Article 4 (disclosure of Inside Information) in Latvia.
In terms of reporting volumes, the rate of increase of data has slowed significantly. The reduction is partly attributed to Brexit, which took a significant number of data and also market participants out of scope.
The breach of article 4 was announced by the Latvian Utilities Commission (Latvian National Regulatory Authority) in September 2021 and relates to an incident in November 2019. The market participant concerned had disclosed an outage of an asset and failed to update the relevant message when the asset returned to the market early. The newsletter examines the breach in relation to both the REMIT Regulation and the REMIT Guidance. No fine was issued.
ESMA has opened a consultation on the “trading venue perimeter” which can be found here. This follows a report last year which examines, amongst other things, whether a technology platform may be considered a “multilateral system” under MIFID II.
