While we do not have the same  split in Europe, will are beginning to see more empowerment of the Energy National Regulatory Authorities, via REMIT etc.

At the same time, we have the debate about whether physical forward deals are derivatives, which has a link to EMIR and MiFiD II. Some of these features mirror what you can find in the article.

It will be interesting to see how the jurisdictional issues between energy and financial authorises pan out once all of these rules reach implementation, both in pan European terms and also on a country by country basis.
