The case against a market participant in Spain for market manipulation has moved forward with the prosecutor’s office filing a compliant. A report on the filing can be found here on the web site of El Periodico de la Energia. It follows action by the CNMC last July (see here).

Nordpool has issued its latest Market Surveillance newsletter, which can be found here. It looks the new Intra Day Auctions, and examines how participation, or non participation, may be viewed in terms of the new version of REMIT Article 5 (the anti abuse provision). In particular it examines the concept of withholding and the addition of the prohibition of “engaging in any other behavior” as part of the market manipulation prohibition.
