This post continues the “catch up” series to cover key items that occurred during our “offline” period (see here for the catch up on REMIT).
CBAM
October 1st saw the start of reporting under the EU Carbon Border Adjustment Mechanism (see here). Any imports of the covered commodities (electricity, hydrogen, cement, iron, steel, aluminium and fertilisers ) from then on must be reported by “CBAM declarants” as part of the pilot which runs until the end of 2025. The first reports are due by 31st January 2024. The European Commission ran a series of webinars and issued commodity specific guidance. These included a session and presentation on electricity, which contained practical information on how to derive the correct figures to report. The various presentations can be found here.
It has been reported that the UK is also planning a CBAM over the coming period (see here for an article on the FT website).
EMIR REFIT
The start of EMIR REFIT approaches with the EU date being at the end of April(see here) and the UK date being at the end of September(see here). Part of REFIT style changes across the world involve the use of the Unique Product Identifier (UPI). The official UPI database from ANNA is now live as announced here.
ESMA also issued an updated version of the reporting guidelines which can be found here.
The third and final catch up post will be issued in the coming days.
