Anti abuse and surveillance articles

Several pieces of news and article have been published recently on the topic of surveillance and anti abuse, with a focus on the US:

This article on the Bloomberg from Securities Law Daily web site by Richard Hill reports on the proposed restructuring by the CFTC of their monitoring unit to the Division of Enforcement.

This article on Marketwatch reports on a case against Lek Securities being brought by Finra which alleges the use of “layering” in order to manipulate the market. The charges are being defended on the basis that the orders were in fact legitimate.

This article on Law 360 by Keith Goldberg reports on the rejection of a class action against a North American oil company for damages causes by alleged manipulation of index prices.

In Europe, anti manipulation rules are found both in REMIT and MAR. This article by Robert Abendroth of KPMG looks at some of the issues around the handing of and disclosure of inside information under MAR, including when it relates to commodities.
